Personal data deletion

You can ask us to review and delete the personal data we process about you. This page explains the available channel, the information needed and the differences between website records, contracted services and systems managed by our clients.

1. Who handles your request

Comercializadora Microtec 2017, C.A., tax registration RIF J-411590681, operates as MICROTEC2017, with its legal address at Parque Central, Caracas, Venezuela, 1010. Send personal data requests to [email protected]. This is our contact channel for reviewing deletion requests and other privacy rights.

When we determine why and how your data is used, for example to handle a business inquiry submitted through this website, we address the request as the controller for that processing. When we work on a client organization's instructions, our involvement depends on those instructions, the contract and applicable law.

2. How to request deletion

Email [email protected] with the subject “Data deletion request”. Explain which information you want deleted and your relationship with MICROTEC2017. You may request deletion of all relevant data or limit your request to a particular inquiry, contact, account or service.

The email link opens your email application and prepares the subject. You still need to write and send the message. Opening the link does not register a request, establish receipt or automatically delete information. Review and execution require human involvement; this page does not provide an instant deletion tool.

3. Information that helps locate your data

Include only what is necessary to distinguish your records from someone else's. You do not need to identify a legal provision or explain personal reasons for asking us to review deletion. If you do not know a date or identifier, provide an approximate reference and describe the interaction.

  • Your name and the email address used for the inquiry or business relationship, if different from the address you are writing from.
  • The approximate date, product or service and, where relevant, the organization whose platform you used.
  • The requested scope: a particular inquiry, contact information, communication preferences or the records we may process about you.
  • A phone number only if it was used for that interaction and is necessary to locate the record.
  • A safe way to reply and any relevant information about an earlier related request.

4. Proportionate identity verification

Before deleting or disclosing information, we need to prevent someone from acting on another person's behalf without authorization. We may ask for clarification or check control of the email address associated with the interaction. Additional information must be proportionate to the risk, the data involved and reasonable doubts about identity.

Do not send identity documents, passwords, access codes, bank cards, medical records or complete case files in your first email. If an additional check is essential, we will explain what is needed and how to provide it with less exposure. An authorized representative or guardian must establish authority to act without submitting documents unrelated to the request.

5. Website records and business communications

Our review may cover information submitted through the contact form, inquiry content, your name, email and optional phone number, your WhatsApp contact preference, the product or plan discussed and related business correspondence. Each category is assessed according to where it is held and the purpose that remains valid.

The form stores the inquiry before processing notification and acknowledgement emails. Related information may therefore exist in both the contact database and email mailboxes. Removing a database entry does not establish that every copy of the correspondence has disappeared. Our response will distinguish the scope reviewed and any necessary retention.

6. Platforms and data managed by clients

Our services include custom software, automation and AI, an enterprise suite, WhatsApp assistants and customer service, clinic, ERP, CRM and banking solutions. An organization's use of MICROTEC2017 technology does not mean that we determine how it processes all information about its users, patients, employees or customers.

If your request concerns an organization that administers a platform, also direct it to that organization. As a processor, we can assist within our obligations and authorized instructions, but cannot unilaterally delete a client's records. This allocation does not exclude our own obligations. With installations on a client's own infrastructure, we may have no access to the data. A software license or development service does not imply permanent access to that infrastructure.

For an installation on client infrastructure, the environment is checked against the agreed security, backup and protection requirements needed for installation. Requests to delete data controlled by that organization should be addressed to it. This check does not give MICROTEC2017 automatic access to servers or data and does not replace ongoing administration of the environment.

After contracted support ends, the client is responsible for operating its servers and managing its data. Ending support does not automatically delete or migrate those data. MICROTEC2017 retains its obligations relating to the installed software and licenses that remain in force, its own data protection obligations and other mandatory legal requirements.

7. What deletion may involve

Depending on the circumstances, an appropriate measure may involve deleting records, removing identifiers, erasing accessible copies or irreversibly anonymizing information where that alternative is legally acceptable. Replacing your name with a code is not enough to establish that information is no longer personal if we can still link it to you.

Where a contracted service includes search indexes, numerical representations used for information retrieval, imported files or integrations, the review should consider those locations and available permissions. Not every product uses those components. The response should clarify what was deleted, what requires action by a client or provider and which limitation prevents further deletion.

8. Ordinary contact form retention

The website contact system is configured to remove technical details after 30 days and submissions and their related delivery attempts after 12 months. Scheduled cleanup runs daily and excludes messages being processed for delivery; ordinary physical removal may occur at the next run after the threshold.

These periods describe the contact form database, not a single retention period for every system, mailbox, contract or client service. They also do not require you to wait until the period ends before making a valid request. Rights requests are assessed against the circumstances and applicable law, independently of the automatic cleanup schedule.

9. Email, backups and providers

Correspondence delivered through Microsoft services, backups and provider systems may follow retention and deletion processes different from those of the contact form database. We do not describe cleanup of that database as simultaneous erasure of every replica, mailbox and backup.

Where a copy cannot be removed immediately, restricted use, the relevant replacement cycle and measures to prevent a restore from unjustifiably reactivating deleted data must be considered. We will identify relevant limitations we can determine. Technical difficulty does not justify keeping data indefinitely or using it for new purposes incompatible with the request.

10. When some information may be retained

Deletion is not always absolute. Applicable law may require retention of particular tax or accounting documents, records subject to sector rules or information needed to establish, exercise or defend a legal claim. Limited security evidence or a record of how your request was handled may also be necessary where there is a valid basis.

Any exception must relate to specific data and purposes. If partial retention is appropriate, we will explain the reason, scope and relevant period or criterion, with restricted access and use. A dispute does not justify keeping an entire file indiscriminately; data no longer needed must be assessed separately. Obligations affecting clinics or financial institutions depend on their particular context.

11. Response deadlines and outcome

We handle requests without undue delay and within the applicable legal deadline. There is no single deletion deadline for every country. Where the European Union General Data Protection Regulation applies, a response must be provided no later than one month after receipt. An extension of up to two further months must be justified by the complexity or number of requests, with notice of the reasons within the first month.

Where a deletion request falls under California privacy law, the response period is generally 45 calendar days and may be extended by another 45 days subject to its requirements and notice. These regimes do not apply simply because you visit this website. Our response will identify the action taken, necessary clarification or reasons for a full or partial refusal and the available ways to challenge it.

12. Rights in different territorial contexts

In Venezuela, Article 28 of the Constitution recognizes access to information about oneself, its use and purpose, and the ability to ask the competent court to update, correct or destroy inaccurate data or data that unlawfully infringes one's rights. Our direct contact channel allows you to submit a request without first obtaining a court order.

Other countries in Latin America and the Caribbean, the United States and Spain may provide specific rights and procedures. Applicability depends on the law's territorial scope, the controller, the service and the circumstances. You may indicate your country to help with that assessment; residence alone is not assumed to activate every law. This page does not replace mandatory rights or prevent you from contacting a competent authority or court.

13. WhatsApp and external services

You can ask us to stop using your phone number for WhatsApp contact or to review deletion of conversations under our control. Withdrawing that preference does not erase an entire conversation history. Available deletion functions depend on the platform, its conditions and the copies retained by each participant.

Disconnecting an integration, withdrawing a permission in Meta or deleting an external service account does not automatically remove existing information from every connected system. Similarly, deletion at MICROTEC2017 does not guarantee deletion of copies kept by other controllers. We will coordinate any legally required communications and explain when you need to approach the provider or organization controlling those data directly.

14. Contracts and other privacy rights

A deletion request does not automatically cancel a contract, waive outstanding amounts or replace an agreed service closure or data return procedure. Equally, exercising a privacy right cannot be made conditional on paying a debt. Any contractual retention requires a valid, limited justification.

If deleting particular information would prevent a function you want to keep, we will explain that consequence so the request can be scoped appropriately. You can also seek access, correction, restriction or objection where available, or withdraw consent for future uses. Free handling and any exceptions are governed by applicable law; buying a service is not a requirement for submitting a request.

15. Review, complaints and follow-up

If you consider our response incomplete, write to [email protected], identifying the earlier request and the point you want reviewed. You may ask for clarification about retained data, the basis for retention or the scope of deletion. Any review or appeal rights provided by applicable law remain available; these procedures are not assumed to be identical across jurisdictions.

You may complain to the competent data protection or consumer authority where appropriate, or use available court procedures. In Spain, you may contact the Spanish Data Protection Agency where it has jurisdiction. This policy complements our privacy notice and does not limit supervisory powers or remedies available to you under mandatory law.
